The Bombay High Court, in relief to GoDaddy, has imposed interim-stay single-judge bench order directing the internet domain registrar to inform the food delivery giant, Swiggy whenever a domain name containing the mark 'Swiggy' is registered.
The Division Bench of Justices KR Shriram and Rajesh Patil while taking up appeal filed by GoDaddy against the January 23rd order, passed the stay order.
Swiggy had moved Delhi High Court alleging copyright infringement by john does using domain names deceptively similar to its mark. A single-judge, in Nov 2022 directed GoDaddy to suspend present as well future registrations of domain names containing the mark 'Swiggy' during pendency of a suit filed by Swiggy.
GoDadddy sought modification of the above and another single-judge directed it to instead inform Swiggy about any infringement so that appropriate action could be taken.
The single-judge bench passed the order much to Swiggy's interest and in face of the 'peculiar situation' as the entities posing as associates of Swiggy were duping people of money under the promise of hiring them for 'Swiggy Instamart' platform.
Aggrieved, GoDaddy filed the present plea.
