Advocate Gautam Khaitan, one of the accused in the AgustaWestland Money Laundering Case has filed a petition seeking modification or setting aside of bail condition requiring him to periodically report to office of the Enforcement Directorate.
In 2021, while rejecting ED's plea seeking cancellation of Khaitan's bail, the court had directed him to report to the ED's office once a week as part of the bail condition.
Later, in 2022, Khaitan filed for modification of the said bail condition citing ailments and terming it as futile exercise which was allowed by court reducing the period to one month instead.
On the other hand, ED had opposed the plea alleging that the accused-advocate was taking advantage of Covid-19 to seek waive-off of condition imposed to prevent him from tempering with the evidence.
With the pandemic approaching its end, the need for revocation of the condition doesn't arises, the agency had contended.
The ED in the present petition has stated that it shall file its reply by the next hearing fixed for April 3rd. The main hearing is scheduled for March 22nd.
The Rouse Avenue Court was also apprised that the communication between the Indian and the Italian Government regarding service of summons is already on record.
The case that stems from the previous government of UPA has marred the Advocate with allegation that he received kickbacks for the ₹ 3,600 defense deal with Italian chopper manufacturer AgustaWestland for 12 AW-101 choppers.
