On Monday, the High Court of Gujarat asked the Bar Council of Gujarat (BCG) to state what training programmes it has undertaken to teach lawyers courtroom etiquette, courtesy & workplace decorum.
The bench of Acting Chief Justice A J Desai & Justice Biren Vaishnav sought details about the programmes conducted to train the lawyers on the basis of directions issued by the HC in 2020 in this regard.
The High Court had filed a suo motu PIL after Justice Bela Trivedi on Dec 19, 2019, passed an order for initiation of continuous education & training programmes for advocates. Justice Trivedi had imposed a fine of Rs 10,000 on Girish Das, a lawyer, for his allegedly unwarranted arguments during a hearing.
The High Court had insisted that the Bar Councils & the Govt should conduct continuous training programmes for advocates so that “the cause of administration of justice does not suffer because of the incompetence of advocates”.
“An advocate/lawyer is supposed to be governed by professional ethics, professional etiquette & professional ethos which are a habitual mode of conduct. He/she must perform himself with elegance, dignity, & decency,” the High Court’s PIL said & added, “Therefore, it is necessary to direct the authorities to carry out continuous education & training programmes because the administration of justice should not suffer because of a few advocates.”
