On Friday, the Supreme Court observed that members nominated by the LG to the MCD cannot participate and vote in the polls to elect the mayor.
A three-judge bench of CJI DY Chandrachud, Justice PS Narasimha and Justice JB Pardiwala also directed the Lieutenant Governor (LG) of Delhi to announce date of the polls to elect the mayor within 24 hours.
The Court directed that election for mayor shall be held at first meeting of MCD. The Mayor then will preside over the election of deputy mayor.
Notice for the election of mayor and first meeting of MCD shall be issued within 24 hours and notice shall fix the date on which election of mayor, deupty mayor and standing committee members shall be held in terms of above direction, the Court noted.
Alderman cannot vote and this is the basic principle of democracy, the CJI remarked.
AAP's Shelly Oberoi has challenged the LG's decision to allow members nominated by him to the Municipal Corporation of Delhi to vote in the elections for mayor and deputy mayor.
She also sought conduct of the election for mayor to the earliest as the voting for the Municipal Corporation took place last year and Delhi hasn't got the Mayor yet after two months.
