Advocates in the district court, Bhopal, extended their strike till March 2 in protest against an administrative order of the Chief Justice of Madhya Pradesh High Court asking the judges in the district courts to clear the backlog of pending cases by disposing of 25 oldest cases in their court every quarter of the year.
The lawyers at some places including Bhopal have been on strike against the chief justice's order for the last 5 days. On Monday, they decided to further extend the strike till March 2.
The State Bar Council, which had also called for a strike across the state on the issue on Friday had called off strike following intervention of chief justice of MP high court Justice R V Malimath, who assured a delegation of the State Bar Council to look into their demands. But a five-day strike undertaken by the District Bar Association at Bhopal & some other districts has continued.
President of the District Bar Association, P C Kothari, when asked what problem the advocates should have if the chief justice is trying to clear the backlog of cases in the district courts, said that if the chief justices doesn't revoke his order, the new cases would only be heard in November as the order says that disposal of 25 oldest cases from January to March, then the next batch of oldest cases in next 3 months & another 25 old cases in the next two quarters of the year.
He said emphasis on disposal of cases rather than doing justice to people is neither good for litigants nor the lawyers. It's like disposing of cases without caring to do justice, he said.
He said that they are not against disposal of old cases, but new cases should also be heard at the same time. "Majority of lawyers are young. If they get a case today & it's hearing takes place in Nov, how would they survive,” asked Kothari.
He said that representatives of lawyers had requested the chief justice to revoke the order, a memorandum was also presented to him but when there was no action, they had to resort to strike. There was a strike in 14 districts including Bhopal on Friday & it would continue on Saturday, he said.
On the other hand, sources in the registry of the Madhya Pradesh High Court said that old cases were like a debt on the courts that the courts must overcome.
