While hearing the Google vs CCI case, consecutively for a second day, the Supreme Court disposed of Google’s petition and refused to interfere with the order of NCLAT (National Company Law Appellate Tribunal’s) refusing an interim stay on Rs. 1,337.76 crore penalty imposed by CCI (Competition Commission of India). The bench led by Chief Justice of India DY Chandrachud further noted that NCLAT directed Google to deposit 10% of the penalty and granted one week to Google for the same. Moreover, NCLAT postponed the hearing of Google’s appeal against CCI to April 2023.
Justice PS Narasimha and Justice JB Pardiwala observed that “Findings by CCI cannot be said to be without jurisdiction or with manifest error.” During the hearing, Advocate AM Singhvi submitted that CCI had no right to interfere in Google’s business. Moreover, Google warned that if CCI’s orders were to be followed then developers would have to pay a higher cost. They also said that “They will no longer have the level playing field they have today with Android and larger developers who can support a wider range of incompatible forks, will be able to dominate the market based on their scale, rather than the quality of their product.”
