The Supreme Court has asked the IPL Founder, Lalit Modi who is in the middle of a family fued to take down public remarks on the members and Senior Advocate Mukul Rohatgi who is representing his mother Bina Modi.
The Division Bench of Justice Sanjiv Khanna and Justice M.M. Sundresh while refused to pass a written order, has orally instructed Modi’s Counsel Senior Advocate Harish Salve to advise his client to take ‘remedial measures’.
Whenever you start to fight like this in the public, it is always detrimental to both parties in any litigation. It only leads to retaliation in a similar manner. Parties are mature enough to understand not to give in to such outbursts. Remove all this,” the judge said. He added, “Your legal battle is entirely separate. But do not involve the lawyers in your battle", the Court said.
To this, the Court was apprised that the said post has been taken down. Last week, it was brought to the notice of the Court while deciding Modi's appeal over the maintainability of an anti-arbitration suit filed by his mother and his siblings, that the businessman has bursted out on the opposition Cousel, Mr, Rohatgi on public platform.
Trigerred by the latter adressing him as a 'fugitive', Modi took to instagram to express his displeasure and add to the banter. He, however apologised later on.
Taking severe objection to the allegations made by Modi in the post, Senior Advocate Kapil Sibal urged the bench headed by Chief Justice D.Y. Chandrachud to pass appropriate orders directing Modi to take down the objectionable comments.
Modi's Counsel Sr. Advocate Harish Salve came to his defence and argued that there was no breach of a legal undertaking and that “the comments were personal and had nothing to do with the mediation.
