The Delhi High Court dismissed a review petition which challenged the order of the High Court dated November 30, 2022 vide which the petition challenging the appointment of the Chief Justice of India DY Chandrachud was dismissed.
“The petitioner is not able to show any error apparent on the face of the record. There are no grounds to interfere with the impugned order passed on November 30, 2922. The petition is accordingly dismissed.”
Moreover, Rs 1 lakh as cost was imposed on the Petitioner Sanjeev Kumar Tiwari by the division bench comprising Hon’ble Justice Sanjeev Sachdeva and Hon’ble Justice Vikas Mahajan.
It was expounded by the bench that the plea was essentially an appeal “disguised as review”and it did not fall “within the four corners of review”.
The review petition was originally listed before the Bench consisting of Hon’ble Chief Justice Satish Chandra Sharma and Hon’ble Justice Subromonium Prasad. But the bench recused itself from hearing. Hence, the matter was then listed before the present bench.
