[Breaking] SC stays Former DU-Professor Saibaba's release in special hearing

In special sitting on Saturday, the Supreme Court has allowed the appeal of Maharashtra Government against Bombay High Court's order to release Former Delhi University professor GN Saibaba in UAPA Case.

The Bench comprising of Justice M.R. Shah and Justice Bela M. Trivedi observed that High Court has not considered the merits and discharged the accused only on the ground that sanction was invalid and some material which was placed before the appropriate authority and sanction was granted on the same day.

The Bombay High Court’s Nagpur Bench on Friday had acquitted him in an alleged Maoist link case and directed his immediate release from the Nagpur Central Jail, setting the wheelchair-bound academician free after eight years of incarceration.

The HC has said that the sanction order issued to prosecute the accused under the stringent provisions of the Unlawful Activities Prevention Act was “bad in law and invalid”. Moments after the acquittal, the Maharashtra Government moved the Supreme Court urgently to seek a stay on the HC verdict.
