The Mother's presence in a child's life is of primary importance unless proven that she is unable to take care of the growing kid's daily needs, the High Court of Punjab and Haryana has observed while dismissing a habeas corpus plea by a man for his ailing second son's custody from his estranged wife who is a CRPF head constable.
The High Court observed, "What is to be seen in the present case is the mental & physical well-being of the child. The mother is an employee of the CRPF & as such has the financial capability to get the best possible treatment for the minor child..."
