Will Forgery Case: Court denies anticipatory bail to 3 Lawyers, Medical Practitioner & 2 Attesting Witnesses

On Tuesday, a Sessions Court in Pune rejected the anticipatory bail plea of 3 lawyers, a medical practitioner & 2 attesting witnesses in an alleged forgery of a will purportedly executed on Dec 18, 2018 by a deceased former senior state government officer relating to his bungalow in society at Dhankawadi.

Additional Sessions Judge B P Kshirsagar said, “Merely because civil proceeding pertaining to the will is sub judice, criminal prosecution alleging the will to be forged cannot be stayed, cannot be quashed but need to be proceeded further".

One of the lawyers is among the 3 heirs of the deceased officer. His elder brother is the complainant in the case. The other 2 lawyers are accused of drafting the disputed will & notarising the same, respectively. The medical practitioner stands accused of issuing a fitness certificate in favour of the deceased for the purpose of preparing the disputed will & the remaining two signed the document as attesting witnesses.

 

An FIR relating to cheating, forgery, use of forged documents & common intention was registered on April 18, 2022 with the Khadak police.

Judge Kshirsagar cited the “suspicious circumstances” brought to his notice by additional public prosecutor Rajesh Kavediya in support of the state’s case to reject the pre-arrest bail plea”.The circumstances cited by Kavediya included a handwriting expert’s opinion that the signatures on the attested copy of the will did not match the signatures of the deceased. He said that the wife of the deceased was alive when the disputed will was prepared, nor does it mention a share to the daughter of the deceased.
