The High Court of Madras has granted bail to a woman arrested in connection with the murder of an advocate over a property dispute in the Theni district. The Court was hearing the bail plea of Mayilammal who was arrested by Uthamapalayam police on Sept 18, 2021. The prosecution case is that several people including the petitioner conspired & murdered advocate Ranjith Kumar following a dispute over property settlement in March 2020.
Justice G Ilangovan said the petitioner had filed repeated petitions before this Court seeking anticipatory bail. Her special leave application was also dismissed by Supreme Court. Suppressing it, she filed an anticipatory bail petition in 2021. When serious suppression of fact was brought to this court’s notice, her anticipatory bail petition was dismissed & Rs 25,000 cost was imposed on her. The Court also pulled up the police for not taking steps to secure the petitioner despite the dismissal of the SLP by the Apex Court. Thereafter, a special team was formed & after a long chase the petitioner was apprehended, said the Judge.
Justice Ilangovan observed that since the prime accused are enjoying bail, it may not be fair on the part of the Court to deny bail to the petitioner citing her past antecedents. Bail can be granted to the petitioner on the ground that she has to file an undertaking affidavit before the trial court stating that she will regularly attend court & cooperate for the completion of the trial process. In case of any violation, the Court is at liberty to take the petitioner into custody.
