In this week, the Madras High Court refused to act on a writ petition seeking reservation for third gender in government jobs.
The division bench of Chief Justice Munishwar Nath Bhandari and Justice N Mala while disposing off the same with no directions, took into consideration submission of Advocate General R. Shunmugasundaram who informed that the Government had already issued necessary orders way back in 2015, granting the benefit of reservation to the community.
He submitted that, pursuant to the judgment of the Hon'ble Supreme Court in National Legal Services Authority Vs. Union of India and others, 2014 Latest Caselaw 256 SC where a direction was given to the Central and State Governments to take steps to treat the transgenders as socially and educationally backward classes of citizens.
In view of the same, the State Govt brought Transgenders under the category of Most Backward Class.
Noting that the writ petition has been filed ignoring the factual position that the transgenders have already been brought under the category of Most Backward Classes and they are getting reservation, the Court dismissed the same.
