As conman Sukesh Chandrashekhar admitted that he paid over Rs 12 crore to Tihar jail officials allegedly to protect himself from being tortured & it was also confirmed by Enforcement Directorate that money changed hands inside jail to allow him to operate from there, the Apex Court on Wednesday decided to get to "the root of the matter" & asked him to the name those who received the money & how he managed to arrange the amount.
A bench of Justice U U Lalit, Justice S Ravindra Bhat & Justice Sudhanshu Dhulia said the names of jail officials who were allegedly paid must be revealed by Chandrashekhar who is seeking transfer to a prison outside Delhi. “We, therefore, call upon the petitioner to submit the list of persons giving all details as to the payments made by any or every one of them & to whom the payments were made. Let all the details be filed before the next date of hearing,” the Court said while posting the case for hearing to July 26.
The Enforcement Directorate told the bench that he paid jail officials to get facilities for his illegal operation from inside the prison & he now wanted to shift to another jail as his illegal activities in Tihar got exposed & he was caught bribing jail officials. Senior advocate R Basant, appearing for the conman, said his client had paid the money but it was not a bribe. He said Chandrashekhar was forced to pay the jail officials as he was facing threat to his life & was being tortured inside jail.
ED also filed a detailed affidavit opposing his plea & said Chandrashekhar had set up a full-fledged office inside Tihar jail in connivance with a few officials by bribing them & was running an extortion racket from there.
The Enforcement Directorate said that "The present plea for shifting out of Tihar is yet another ploy to repeat the same misdemeanours in another jail facility & exploit the loopholes where the jail authorities are not familiar with his innovative methods of conmanship. Tihar jail has already deployed suitable & sufficient measures & mechanism to check & contain any possibility of the petitioner accused repeating his misdemeanours within the jail".
Chandrashekhar contended that there are 37 cases pending against him in different parts of the country & pleaded that he be shifted to any other jail outside Delhi. Earlier the Enforcement Directorate suggested that the accused can be shifted to another jail within Delhi but the conman opposed it saying that he wanted to be shifted to a jail which is not controlled by Delhi Police.
