HC comes to rescue of Lady Convict who was unable to arrange Sureties, released on Personal Bond,

 

The Delhi High Court has recently granted relief to a female convict by modying suspension of sentence condition for deposit of surety bond as she was unable to arrange securities.

The single-judge bench of Justice Jasmeet Singh allowed the applicationand ordered filing of personal bond instead.

The applicant’s sentence was suspended on 19.01.2022 but she was not able to avail the benefit of the same for want of 2 sureties. In view of this, the Court had previously modified the condition, wherein personal bond and surety was reduced to Rs. 15,000/- and the surety was permitted to be somebody other than a family member.

 

However, the applicant has not been able to fulfill the same as well.

Her Counsel submitted that condition requires further modification. Stating that the applicant has a permanent place of residence, he pleaded that she be relaesed on personal bond only, without any surety.

 

The Court was of the view that once an order of suspension has been passed, the applicant must be entitled to its benefit in its true letter, spirit and intent and her liberty cannot restricted for the reason that she could not furnish surety.

It thus further modified the condition and directed the applicant to be released on a personal bond of Rs. 10,000/.

She was however asked to report to the nearest ocal police station.

 

It was further being directed that the applicant shall share her mobile no. with the Investigating Officer and mobile no. shall be operational at all times. The live pin of the location of applicant shall also be on all the time.
