HC let's off Advocate who abused Lady Judge in Court upon submission of Apology, imposes ₹2000 Cost,

The Allahabad High Court has accepted the unconditional and unqualified apology of an Advocate for hurling insults towards a Lady Judge during course of hearing.

The Division Bench comprising of Justice Suneet Kumar and Justice Vikram D. Chauhan while closing the contempt case, however has fined the Advocate with a cost of ₹2,000/- which is to be deposited at the District Legal Services Authority.

Additionally, he is to be kept under observation for a period of two years with regard to his conduct and behavior.

The High Court had levelled charges agauinst Contemnor/Advocate Krishna Kumar Yadav stating that by his conduct, he had insulted the court and had tried to lower the authority of the court and had also obstructed and interfered with the due course of the judicial proceeding.

In view of this proceedings under Section 12 of the Contempt of Courts Act, 1971 was initiated nad he was called upon to submit his defence.

 Initially, he filed an objection/counter affidavit to the charge raising preliminary objection with regard to the maintainability of reference/proceeding, denying the allegations and factum of the incident. However, he had also mentioned the fact that he had tendered unconditional apology to the concerned lady judge.

 

Thereafter, he submitted that the he desired to withdraw the objection to the charge and tenders an unconditional apology. Pursuant to this, he pleaded for mercy with folded hands and rendered his apology before the Court stating that the he is a practicing lawyer having standing of 31 years in the District Court at Mau and therefore,his unconditional and unqualified apology be accepted and notice be discharged while assuring the Court of good and appropriate conduct in future.

The Court remarked that what the Counsel has done is 'unbecoming of a practising advocate' and his conduct is more upsetting in view of the fact that he is former President of the Bar and been in the profession for 32 year,
