HC quashes FIR against husband due to compromise agreement between husband and wife

The Single Bench of High Court of Jammu & Kashmir and Ladakh consisting of Justice Tashi Rabstan quashed FIR under Sections 498-A, 323, 506 and 109 IPC against husband due to compromise agreement between husband and wife.

Facts and Procedural History

Filing of above-mentioned FIR against the petitioners was the consequence of a matrimonial dispute. During hearing of this petition, learned counsel for petitioners stated at the Bar that petitioner No.1 and respondent No.4 have entered into a compromise. When the matter was taken up for hearing, it was brought to the notice of Court that petitioner No.1 and respondent No.4 entered into a compromise agreement and were living together happily. As such, they were directed to record their statements before the Registrar (Judicial) of the Court. Accordingly, their statements were recorded before the Registrar (Judicial) and admitted the contents of compromise agreement. They further stated that they settled all their disputes amicably and were living together happily.

Respondent also stated that she does not want to pursue the above-referred FIR registered against the petitioners and has no objection in case the same is quashed.

Judgment


Therefore, in view of above and without going into the merits of the case, the Bench deemed it proper to allow the petition and quash the FIR.
