A Court has granted bail to gangster Rohit Gehlot, who was shot in the leg by police allegedly in an encounter, saying the version of the investigating agency doesn't inspire confidence.
Metropolitan Magistrate Alka Singh granted relief to Rohit Gehlot, accused in the Mittal sweetshop shootout that took place on Oct 30, 2021.
Police alleged that he had tried to shoot the police personnel who were trying to arrest him. The Court noted that the encounter took place on Nov 3, 2021, but the name of the accused was disclosed only on Nov 4 and, as per the CCTV footage, he was picked up from his residence on Nov 1, that is even before the alleged involvement according to the version of the DCP concerned came to the fore.
“Moreover, as per the chargesheet, though the police personnel were firing at the accused in their self defence, it has also been written that the accused had at one point started to run away; however, he was again fired upon by the police personnel in their self defence & was hit by the bullet in his left leg, which is not at all convincing as this is the basic principle of right of private defence that it ceases to exist as soon as assailants start to retreat,” the Judge said in the order on Jan 4.
The Court further noted that the police version didn’t inspire confidence as the accused was picked up two days before the alleged encounter. It added that the fact that among all the officers of the raiding team only a constable who was wearing a bulletproof jacket was hit by a bullet, allegedly fired by the accused, makes the entire claim “absurd & doubtful”.
