Spiritual image of India dented with inclusion of 'secular' in Preamble, says this Chief Justice

 

Chief Justice of Jammu and Kashmir and Ladakh High Court Pankaj Mithal on Sunday said that the inclusion of words like ‘socialism’ and ‘secular’ in the Preamble of the Constitution in 1976 would help the country’s spiritual development. He said these things at a function organized by the Advocates Council of Jammu and Kashmir and Ladakh. Here he was speaking on the topic ‘Religion and Constitution of India: Interaction’.

Pankaj Mitthal said that India is capable of taking care of all its citizens and there is a socialist nature in it (India’s Spiritual Image). He said that from the Pandavas to the Mauryas, the Guptas, the Mughals and the British ruled this country, but India was never defined as a Muslim, Christian or Hindu nation on the basis of religion, as it was a spiritual country. was accepted as The judge said, by adding the word ‘secular’, we have narrowed our enormity of the spiritual nature.

Narrow-minded approach

He further said that ‘this can be called a narrow-minded approach.’ Otherwise India has been a spiritual country since time immemorial and it should have been named ‘Spiritual Republic of India’. Referring to the amendments related to the Constitution, he said that it is good to have amendments as they prove to be helpful, but those which are not in the national interest are of no use. He said, ‘Sometimes we bring amendments because of our insistence.

Mentioned two amendments

Speaking in this context, Justice Pankaj Mitthal referred to two amendments brought in the Constitution in 1976 – adding Fundamental Duties in Chapter 14 and adding the words ‘socialism’ and ‘secular’ in the Preamble. He said, ‘These are very good words, but we have to see whether these amendments were needed or have they been added at the right place?’
