On Thursday, the High Court of Gujarat reunited an interfaith couple who had eloped last year but were separated after they were tracked down. The Hindu man was arrested on charges of rape & violation of the Protection of Children From Sexual Offences Act (Pocso) & the Muslim girl was put in a shelter home in Junagadh for more than a year.
According to the case details, the couple is from Kodinar block in Gir Somnath district. In Aug 2020, they eloped & the girl’s father lodged an FIR against the man accusing the 22-year-old of rape & violation of the Pocso Act because the girl was a minor at the time. Police nabbed them in November. As there were criminal charges against the man, police arrested him & sent him to judicial custody.
They sent the girl to a shelter home in Junagadh, Shraddhar Gruh.
For nearly 10 months, the couple could not communicate because the man was in jail & girl was at the shelter home & was not allowed to meet anyone. In September, the high court granted bail to the man, who tried to contact the girl but did not succeed. He moved the high court through advocate Prashant Chavda & filed a habeas corpus petition, stating that his beloved was an adult & had been kept at the shelter home illegally & against her will. He also cited the girl’s statement during the trial, showing that she told the sessions court that she was in love with this man, but as they are from different religions, their families were averse to their union. She was engaged to a man she did not like & therefore decided to elope with her boyfriend. She wanted to marry the accused.
After perusing the documents, the high court summoned the girl & asked what she wished. She told the judges that she would like to go with the man & they would get married. The HC ordered to free her, “…considering her age & willingness, we set her free to join the company of petitioner”.
