Can a Lawyer challenge his non inclusion in the Panel recruited by a Bank? HC answers, Read Order

The Karnataka High Court has held that a Lawyer cannot challenge his/ her dismissal from a Panel as it is a matter of discreation.

Dismissing petition of a Lawyer who was previously empanled at Bank as their Legal Representative and was challenging his dismissal from the same, the single-Judge Bench of Justice Krishna S. Dixit, stated that the matter is of discreation of the Bank concerened and such dicreation involves various factors such as fiduciary relationship of 'Client and Counsel'.

The Court reasoned that it cannot deeply examine into such a factor and therefore a writ cannot ordinarily interfere.

The Court added that the Bank has exercised its prerogative in empaneling Lawyer of its choice and not picking up the petitioner.

The Court observed that such an exercise by the Bank cannot be faulted subject to all the exceptions to which the petitioner's case doesn't fit.
