HC: Existence of a Hotel with Bar near School does not impair minds of Students

The Bombay High Court has observed in one recent ruling that a bar-attached hotel in the vicinity of a school will not affect the minds of children studying.

The Court while dismissing a petition filed by two Social Workers against a bar hotel in Pune town said that the bar hotel is situated outside the distance limit fixed by the Govt and therefore its functioning is strictly as per rules specified.

The Court further added that no adverse incidents have been reported of any law and order problems cropping up as a result of the bar. So the Court declined to interfere with the Govt Order granting licence to the bar.

Citing lack of evidence, the Court dismissed the plea since no action could have been taken.

The Court concluded:


"Present day education system is to enable the student community to face any challenges in their career.  The functioning of the bar doesn't affect them. It will not vitiate their minds. No adverse inference can be drawn."
