New Delhi: The Madhya Pradesh high court has denied anticipatory bail to a man accused of alleging on social media that the Rashtriya Swayamsevak Sangh is a “terrorist” organisation.
LiveLaw has reported that one Atul Pastor had written a post on social media likening the RSS – the ideological fountainhead of the Bharatiya Janata Party which forms governments in both Madhya Pradesh and the Centre – to a “Taliban terrorist organisation.”
Pastor’s post went viral, according to the report and he was booked under 153 (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language), 295 (injuring or defiling place of worship with intent to insult the religion of any class), 505 (1) (statements conducing to public mischief), and 505 (2) (statements creating or promoting enmity, hatred or ill-will between classes) of the Indian Penal Code.
The state has argued that Pastor “created nuisance and instigated the religious sentiments of the public.”
Pastor’s counsel said that he has been falsely implicated and never made comments on any religion or organisation.
The court, however, refused his plea and said there was “sufficient evidence” available against him.
The Supreme Court and India’s other high courts have, from time to time, exhorted upon courts to recognise the right to seek default’ bail as a fundamental right, advocating for quick bail instead of incarceration.
LiveLaw has also reported on the Allahabad high court granting bail to a man who had been booked for posting an image of Prime Minister Narendra Modi that was allegedly objectionable.
The bench of Justice Mohammad Faiz Alam Khan said, “It is to be known to one and all that the Prime Minister of this country or any Constitutional dignitary could not be confined to a particular class or religion as he is representing each and every citizen of this country.”
