Tamil Nadu can't form panel to go into impact of NEET without leave of SC: High Court

On Tuesday, the Madras high court observed that the Tamil Nadu Government cannot constitute a committee to go into the impact of NEET on MBBS aspirants from socially backward classes without the leave of the Supreme Court.

“There can be little room for the state to set up any committee for the purpose of ascertaining whether the NEET-based admission process has prejudicially affected socially backward students,” the first bench of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy said.

The court made the observation on the basis of the submission made by the petitioner that any recommendation made by the committee cannot be implemented in view of the orders passed by the apex court on the National Eligibility cum Entrance Test.

The court then gave a week’s time for the Tamil Nadu government to respond to the plea.

The issue pertains to a PIL moved by BJP state secretary K Nagarajan seeking to quash an order issued by the Tamil Nadu government on June 10, constituting a committee headed by Justice A K Rajan to study the impact of NEET.

When the plea came up for hearing, advocate general R Shunmugasundaram argued that the constitution of the committee was a policy decision of the state backed by the election manifesto of the ruling party and demand of the people.

“May be. But if it is contrary to the Supreme Court order, then it cannot be permitted,” the bench said before adjourning the hearing.
